Delivery terms

General Terms and Conditions of Business

All our business relations are based on the following General Terms and Conditions of Business as at 30.09.2010: offers, services and deliveries by us take place solely on the basis of these General Terms and Conditions of Business. Deviations from these Terms of Business shall only be effective if we confirm them in writing. Should any provision of these Terms of Business or any provision within the scope of the other agreements be or become ineffective, this shall not affect the validity of the remaining provisions and agreements. As deposited with the Chamber of Commerce under number 65394496.

Offers subject to change
Offers made on our homepage, in prospectuses, advertisements and price lists regarding weight, size, filling and price are without obligation and only become binding if they are stated on the delivery note or explicitly referred to. Weight losses due to natural shrinkage, storage or similar cannot be ruled out and shall not be borne by us. The terms and conditions of the Distance Selling Act shall apply as set out below. The contract is concluded when we confirm our acceptance in writing or by e-mail within a period of 4 weeks or when the goods are accepted without reservation upon delivery. A possible rejection of the order or the deliverability will be communicated by us as soon as possible.
Please note: The weight of each product may differ from the weight stated in the web shop, but the total value of your order will always be equal to or greater than the amount paid. If the total amount is lower or a product is not in stock, we will add an extra equivalent product to make the amount still correct.

Delivery conditions
Delivery takes place within 2-7 working days after the order and payment have been made. Deliveries are made subject to force majeure. The orderer agrees to a possible partial delivery.

Delivery costs
It is possible to order from De Woeste Grond from € 5,-. To cover the transport costs (national) we have applied the following scale:

Netherlands:

Orders between € 1,- and € 75,-; contribution to shipping costs € 14,95*.
Orders between € 75 and € 175; contribution to shipping costs € 7.95*
Orders above € 175; no contribution to shipping costs*.

Belgium and Zeeuws-Vlaanderen:

Orders between €1 and €75; contribution to shipping costs €24.95*.
Orders between €75 and €175; contribution to shipping costs €9.95*
Orders above € 175; no contribution to shipping costs*.

For deliveries to the Wadden Islands, a surcharge will be calculated.

Warranty
The purchaser must check the delivered goods immediately upon receipt for transport damage, obvious defects and guaranteed properties. The responsibility of the deliverers (postal services, parcel delivery services, etc.) ends once the goods have been deposited on the recipient's premises and the recipient has accepted them. Damage caused by transport must be confirmed immediately by the carrier on the delivery note or on the invoice, otherwise no refund can be made. Other obvious defects must be reported to us by the buyer in writing immediately within 48 hours. Our warranty does not cover damage caused by improper handling by the buyer or damage caused by natural shrinkage, moisture, overheating, unusual weather and temperature conditions or infestation with insects and beetles. The buyer must prove that the damage is not his fault. Provided there is no intent or gross negligence, claims for compensation for defects in goods, for any legally valid reason whatsoever, are excluded against us as well as against our employees and the persons transporting our goods. We shall not be liable for any consequential damage to other goods or property of the buyer - in particular deterioration caused by pests, rot and the like.

Goods may only be returned if a complaint is made to "Vlees van de Woeste Grond" by telephone or in writing. Complaints must be made within a certain time period:
Incorrect or incorrect delivery up to 48 hours after receipt of the goods.
Defects in the products and damage caused by pests or plants up to 24 hours after receipt of the goods.
One-way packaging will not be taken back by us. We do not accept the return of packaging for environmental reasons and recommend that you dispose of it at a municipal or regional collection point.

Price quotation
All price quotations are in euros including VAT, unless expressly stated otherwise.

Return of packaging
Empty packaging can only be returned with written or telephonic notification and at the expense of the ordering party.

Claiming compensation
Claims for compensation for unlawful acts, for whatever legal reason, are excluded, provided there is no intentional or grossly negligent fault on our part, as well as on the part of our employees and the persons transporting the goods on our behalf.

Retention of title
The delivered goods remain our property until all payments have been made - in case of payment by cheque, until the collection has been completed. If the retention of title lapses due to resale, mixing, obligation or processing, the new fact or the resulting claim shall take the place of the delivered goods (extended retention of title). In any case, the goods remain the property of the supplier until all claims from the current account or business relationship have been paid in full. If the buyer's behaviour is contrary to the contract - especially in the case of late payment - we shall be entitled to take back the goods subject to retention of title at the buyer's expense. Taking back the goods does not mean that the contract is no longer valid.

Terms of payment
All orders placed in the De Woeste Grond webshop shall be paid in advance without exception. When completing the order, several payment options are offered that must be used.
